Toorak Gardens is governed by two numbers that rarely appear in a conversation about a build and quietly decide how big the house can be: a maximum site coverage of 40 per cent, and a side boundary setback of 1.5 m at ground level rising to 4 m above it. Both are more restrictive than the neighbouring suburbs across the council boundary, and together they do more to shape a design here than the height limit does.

Forty per cent, not fifty

Site coverage caps the proportion of the block that buildings may occupy. At 40 per cent, a 750 m² allotment permits about 300 m² of building footprint — and that figure has to absorb the house, the garage, and generally any roofed outbuilding. The adjoining City of Unley suburbs run at 50 per cent, which on the same block is 375 m². Seventy-five square metres of footprint is an entire extra room and a double garage. It is the single most consequential number on this page and it is almost never the one people ask about.

The side setback steps out as you go up

The minimum side boundary setback is 1.5 m for the first building level and 4 m for any second level or higher. That step is deliberate and it shapes the form of a two-storey house: the upper floor cannot simply sit above the ground floor footprint at the sides, it has to pull in substantially. Designs imported from a suburb with a 1 m and 3 m rule do not transfer. If a builder is working from a standard plan, that plan almost certainly needs its upper level reworked, and that is a design cost worth identifying before it becomes a variation.

What the two numbers do together

A tighter coverage limit and a deeper upper-level setback push in the same direction: less footprint, and a narrower upper floor. The workable response is usually a longer, narrower house than owners initially imagine, with the second level set well inside the ground floor. Understanding that at the sketch stage rather than at assessment saves a redesign.

Three heritage instruments, and they are not interchangeable

A State Heritage Place overlay, a Local Heritage Place overlay and a Historic Area Overlay are all mapped. They operate at different levels and are assessed differently: State and Local Heritage Places attach to identified individual places, while the Historic Area Overlay applies to an area and governs how new and altered buildings present, whether or not the particular house is listed. A block can sit under the area overlay without being a listed place at all — which is the common case, and the one owners are most often unaware of. Search for each separately.

Minimum site areas span 250 m² to 750 m²
